These Terms and Conditions govern your use of our website and the watch repair and restoration services we offer. By contacting us, submitting an enquiry, or entrusting us with a timepiece, you agree to the terms set out below. 1. Definitions

The following terms are used throughout this document:

• "Agreement" means these Terms and Conditions, together with any written service quotation or work order accepted by both parties.
• "Service" refers to watch repair, regulation, case refinishing, crystal replacement, antique restoration, conservation, or any related work carried out or offered by us.
• "User" / "Client" / "You" means any person who accesses our website, submits an enquiry, or engages our services.
• "We" / "Us" / "Our" refers to Khwan Dial, operating at 88 Thanon Si Chum, Mueang, Sukhothai 64000, Thailand.
• "Item" means any watch, clock, timepiece, or related object entrusted to us for service.
• "Quotation" means a written estimate of work, scope, and price provided before service begins.
• "Content" means all text, images, descriptions, and other material appearing on our website.

2. Acceptance of Terms

By accessing our website, submitting a contact form, or bringing or sending an item to us, you confirm that:

• You are at least 18 years of age, or have obtained the consent of a parent or legal guardian.
• You have the legal capacity and authority to enter into this Agreement.
• Where you act on behalf of a third party or organisation, you have the authority to bind that party.
• You have read these Terms and accept them without reservation.

If you do not agree with any part of these Terms, please do not proceed with our services. We are happy to discuss any concerns before any commitment is made.

3. Service Description

Khwan Dial offers specialist watch and clock services in Sukhothai, Thailand, including:

• Watch Service and Regulation: full movement service, cleaning, lubrication, and regulation for hand-wound and automatic watches.
• Case Refinishing and Crystal: careful refinishing of watch cases and replacement of worn or damaged crystals.
• Antique Restoration and Conservation: respectful restoration of antique and heirloom timepieces, balancing function with preservation of originality.

Services are available to clients in Thailand and to international clients who arrange delivery. We do not operate as a retail outlet and do not sell replacement parts or watches directly to the public.

All services are subject to prior assessment and quotation. We reserve the right to decline any item we consider unsuitable for our capabilities or that presents unusual risk.

4. User Responsibilities

When engaging our services or using our website, you agree to:

• Provide accurate and complete information about yourself and the item being serviced.
• Disclose any known history of prior repairs, modifications, or damage relevant to the work requested.
• Respond to communications within a reasonable time so work may proceed without unnecessary delay.
• Collect completed items within 30 days of notification, or make alternative arrangements with us.
• Use our website only for its intended purpose and refrain from any activity that could harm, disrupt, or misuse it.
• Refrain from scraping, copying, or reproducing our website content for commercial purposes.

You must not submit items that are subject to any ownership dispute, legal claim, or obligation that would prevent you from authorising the work.

5. Intellectual Property

All content on our website — including text, photographs, design elements, and the Khwan Dial name and mark — is owned by or licensed to us and is protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and view our website content for personal, non-commercial purposes. This licence does not permit:

• Reproducing or redistributing any content without our prior written consent.
• Using our name, mark, or images in any commercial context.
• Modifying or creating derivative works based on our content.

Photographs of completed work that you have shared with us remain your property. We may, with your permission, use them for portfolio or illustrative purposes on our website or printed materials.

6. Payment Terms

Pricing for our three services begins at the following levels, subject to final assessment:

• Watch Service and Regulation: from ฿4,500
• Case Refinishing and Crystal: from ฿8,200
• Antique Restoration and Conservation: from ฿14,900

All quotations are provided in Thai Baht (฿). A written quotation will be supplied before work begins. Your approval of the quotation constitutes agreement to pay the stated amount.

We accept bank transfer and cash. Specific payment methods will be confirmed at the time of quotation. Payment in full is due upon collection of the completed item unless otherwise agreed in writing.

If the actual scope of work differs from the original quotation due to previously undisclosed conditions, we will inform you before proceeding. You are under no obligation to accept the revised scope.

Refunds: Should we be unable to carry out the agreed work, any deposit paid will be returned in full. If work has commenced and you withdraw consent, you may be asked to contribute to costs already incurred, proportionate to work completed. We will discuss this with you fairly and without pressure.

7. Service-Specific Terms

Scope and changes: The scope of each service is established in the written quotation. If additional work becomes necessary during service, we will contact you to discuss options. No additional work will proceed without your agreement.

Timelines: Estimated timelines are provided in good faith but are not contractual commitments. Antique and restoration work in particular may require more time than initially indicated. We will keep you informed of progress.

Condition on receipt: We record the condition of each item on receipt. Any pre-existing damage will be noted in writing. We are not liable for pre-existing conditions not identified at intake.

Uncollected items: Items not collected within 60 days of notification of completion may be subject to a storage fee. Items uncollected after 6 months may, after reasonable notice, be disposed of to recover costs. We will make every reasonable effort to contact you before taking such steps.

Original parts: Where original parts are removed, we will retain them for collection where practicable. We do not guarantee the availability of spare or replacement parts for all items.

8. Disclaimers

Our website and its content are provided in good faith for informational purposes. While we take care to keep information accurate and current, we do not warrant that the website is free of errors or will always be available.

Watch and clock servicing involves inherent risks, particularly with aged or fragile items. We apply care and skill consistent with professional standards, but cannot foresee all outcomes with antique or previously damaged pieces.

We do not make undertakings regarding the future performance or longevity of any item beyond the scope of work carried out. Ownership of a serviced watch carries its own ongoing responsibilities, which we are happy to advise on.

9. Limitation of Liability

To the fullest extent permitted by law, our liability to you for any claim arising from our services or this website shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not liable for:

• Loss of use, loss of profits, or consequential losses of any kind.
• Damage arising from pre-existing weaknesses or undisclosed conditions in an item.
• Loss or damage during postal or courier transit arranged by you.
• Circumstances beyond our reasonable control, including supply disruptions, natural events, or third-party failures.

Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, or any other liability that cannot be excluded under Thai law.

10. Indemnification

You agree to indemnify and hold harmless Khwan Dial and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from:

• Your breach of these Terms.
• Inaccurate or misleading information you provided about yourself or an item.
• Your infringement of any third-party rights in connection with an item or service.

11. Termination

Either party may withdraw from a service engagement before work begins by giving written notice. If you withdraw after work has commenced, the terms in Section 6 (Payment Terms — Refunds) apply.

We may decline to continue or complete work if it becomes apparent that proceeding would cause harm to the item, is outside our capabilities, or if you have not responded to communications within a reasonable time.

Terms relating to payment, intellectual property, limitation of liability, and dispute resolution survive the end of any service engagement.

12. Dispute Resolution

We hope that any concerns can be resolved through open conversation. If you have a complaint, please contact us in the first instance at [email protected] or by telephone, and we will make every effort to reach a fair outcome.

These Terms are governed by the laws of Thailand. Any unresolved dispute shall be subject to the jurisdiction of the courts of Sukhothai Province, Thailand, unless both parties agree to an alternative form of resolution such as mediation.

Consumer rights under Thai law, including those provided by the Consumer Protection Act B.E. 2522 and subsequent amendments, are not affected by these Terms.

13. General Provisions

• Entire Agreement: These Terms, together with any accepted quotation, constitute the full agreement between us with respect to the relevant services.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent. We may assign our obligations in the course of a business transfer, provided your rights are not diminished.
• Notices: Communications regarding these Terms may be sent by email to the addresses provided, or in writing to our business address. Email communications are considered received on the day sent, unless delivery failure is indicated.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The updated version will be published on this page with a revised date.

Continued use of our website or services after the effective date of any changes constitutes your acceptance of the revised Terms. For significant changes, we will make reasonable efforts to draw your attention to them before they take effect.
